Is magic mushroom delivery in NYC legal?
No. New York licenses no psilocybin delivery, the Penal Law treats handing mushrooms to someone as a sale even when no money changes hands, and the person receiving them is in criminal possession. There's little public reporting on NYC delivery accounts, so this page sticks to what the law says and to the warning signs regulators publish for scams.
From our sister shop, My Mushroom Dispensary. Adults 21+ only.

The short answer
No legal magic mushroom delivery exists in New York City. Psilocybin is a Schedule I drug under state and federal law, New York's cannabis regulator licenses cannabis businesses only, and Penal Law § 220.00 defines "sell" as "to sell, exchange, give or dispose of to another, or to offer or agree to do the same."1, 2, 3, 4 So a courier who hands over mushrooms commits criminal sale, a felony, whether or not money changes hands, and the person who takes them commits criminal possession.4
My Mushroom Dispensary, the online shop for adults 21+ run by the team that publishes this site, isn't a delivery service. It has no drivers or couriers in New York; it sends orders by tracked shipping, and orders placed by 2 PM Pacific ship the same business day. Ordering psilocybin is illegal under federal law and New York law, by courier or by mail.
What are NYC mushroom delivery accounts?
"Delivery" here means a seller who takes orders by text, a messaging app or social media and brings mushrooms, chocolates or gummies to the buyer. Street selling can turn into it: DoubleBlind reported in 2024 that a seller in Washington Square Park who offered its reporter mushrooms handed over a business card.5
When we searched "magic mushroom delivery nyc" on November 2, 2026, the results that offered to sell fell into three groups, and none was an NYC business we could verify:
- A directory listing for a delivery-only "NYC" seller advertising psilocybin-extract gummies. It asked for "a valid MMJ card or ID," linked to a website named for Massachusetts and showed no license number. New York has no medical card or license of any kind for psilocybin.
- Mail-order sellers calling themselves delivery, such as a brand whose November 2025 press release offered "overnight and 2-day shipping" to "select regions" from Oakland, California. That's shipping, which our page on buying magic mushrooms online covers.
- Out-of-town and spam pages: Toronto delivery promotions and spam posted on abused wiki and university web pages.
We don't link or name any of them. A page that ranks for "NYC delivery" isn't evidence that anyone delivers in NYC.
What has happened to NYC delivery sellers?
Very little is on the public record. We found no news report, court record or prosecutor's release from 2023 to November 2026 about an NYC mushroom delivery account, whether on Instagram, Telegram or a flyer. We also found no release from New York's four federal prosecutors' offices about psilocybin sold into the state by mail or courier, though some Justice Department search pages wouldn't load for us. Read that as "not found," not "never happened."
The closest documented cases are hand-to-hand sales. In February 2024, the Special Narcotics Prosecutor and the NYPD charged nine people with selling psilocybin mushrooms, cocaine and crack in and near Washington Square Park after more than a dozen sales to undercover officers. Several pleaded guilty and got sentences from probation to two and a half years in prison; others were awaiting sentencing or were evaluated for drug treatment.6, 7 Undercover buys also built the December 2022 case against two East Village stores.8
We also can't tell you how often NYC buyers get cheated: we found no published figures on scams involving mushroom sellers in the city. What regulators do publish are the general signs of a scam, listed below.
What's the legal risk for the courier and the buyer?
These are first-offense charges.
The courier or seller
- New York: criminal sale in the fifth degree, a class D felony, for any amount (Penal Law § 220.31). It's third degree, a class B felony, at 25 milligrams of psilocybin, and second degree, a class A-II felony, at 125 milligrams (§§ 220.39(5), 220.41(5)).4
- Federal: distributing a Schedule I drug carries up to 20 years (21 U.S.C. § 841(b)(1)(C)). Using a phone, an app or the mail to commit or facilitate that felony is a separate offense each time, up to 4 years (21 U.S.C. § 843(b)).9
The buyer
- New York: criminal possession in the seventh degree, a class A misdemeanor, for any amount, with up to 364 days in jail; fourth degree, a class C felony, at 25 milligrams of psilocybin (§§ 220.03, 220.09(6), 70.15).4
- Federal: simple possession, up to a year in prison for a first offense plus a mandatory minimum fine (21 U.S.C. § 844).9
A friend who picks up for the group
Handing out shares is a sale under Penal Law § 220.00(1), even at cost or for free, and distribution under federal law.4, 9
The phone-and-mail offense in § 843(b) is aimed at the seller's side: the Supreme Court held in 2009 that a buyer's phone call to make a misdemeanor purchase doesn't "facilitate" the seller's felony.10 The buyer's exposure is possession, under state and federal law.
The statutes set these thresholds by the weight of the psilocybin, and in 1993 New York's highest court called psilocybin a substance "measured by 'pure' weight."11 That doesn't mean a bag of mushrooms stays under them: in June 2026, State Police charged a man found with about 45 grams of psilocybin mushrooms with second-degree possession, the class A-II felony set at 625 milligrams.19, 4 First-offense felony sentences run from 1 to 2.5 years for a class D up to 3 to 10 years for a class A-II. New York's Good Samaritan law bars drug charges, other than for selling for money or other gain, against people who seek help in good faith for an overdose or other life-threatening emergency, and it gives a defense to some sale charges.4 Our penalties guide has the full table.
What are the warning signs of a delivery scam?
These come from the Federal Trade Commission's general scam guidance and from what tests of "mushroom" products have found. They describe when a seller is likely to take your money or hand you something else; they aren't a guide to finding a seller.
- Prepayment by gift card or crypto to someone you don't know. The FTC says "anyone who insists that you pay by gift card is always a scammer," and "only scammers demand payment in cryptocurrency."12, 13
- Pressure. "Scammers want you to act before you have time to think," in the FTC's words: a deal that ends in minutes, a "last batch," a second payment demanded before anything arrives.14
- No lab report, or one you can't check. A real report names the testing lab, the batch and the date. Tests of gummies sold as mushrooms have found psilocin, ephedrine and kratom's mitragynine that the labels didn't list, and FDA found 4-AcO-DMT, muscimol and the prescription drug pregabalin in one recalled brand.15, 16
- "Legal psilocybin," "licensed" or "medical card" claims. None of those exists for psilocybin in New York, so a seller who claims one is wrong about the easiest thing to check.1, 3
- An address or website from somewhere else, such as a "NYC" listing that links to an out-of-state site.

Questions people ask
Is it a crime to bring mushrooms to a friend for free?
Yes. Under Penal Law § 220.00(1), "sell" includes to "give or dispose of to another," so handing mushrooms to a friend is criminal sale even when nobody pays.4
Can I get in trouble just for receiving a delivery?
Is shipping mushrooms by mail any different from delivery?
It's illegal too. If distributing a controlled substance is unlawful, the U.S. Postal Service says, "then the mailing of the substance is also unlawful under 18 U.S.C. § 1716."18 Our page on buying online covers federal mail law.
