MushroomsNew York

Is there a legal mushroom dispensary in NYC?

No. New York licenses no one to sell psilocybin, so a mushroom dispensary in any borough is selling illegally whatever its sign says, and selling any amount is a felony. Shops that tried have been raided, from two East Village storefronts in December 2022 to a Bronx shop and a Queens warehouse in 2024.

The short answer

There's no legal mushroom dispensary in New York City. Psilocybin is a Schedule I drug under Public Health Law § 3306, no state agency licenses its sale, and selling any amount is criminal sale of a controlled substance in the fifth degree, a class D felony, or a higher charge by weight.1, 2, 3 Under the Penal Law, "sell" also covers giving it away.2

The team that publishes this site runs My Mushroom Dispensary, an online shop for adults 21+ with no counter in any borough. It lists dried strains such as Golden Teacher mushrooms online and ships them, and orders placed by 2 PM Pacific ship the same business day. That isn't a legal alternative: ordering psilocybin is illegal under federal law and New York law, just as buying it over a smoke-shop counter is.

What are NYC's mushroom dispensaries and shroom shops?

In NYC reporting, they're mostly smoke shops, CBD stores and bodegas selling psilocybin products on the side. DoubleBlind, in July 2024, said the East Village seems to be "the epicenter of the city's underground mushroom market": most of the smoke shops and some of the bodegas its reporter visited there carried products sold as psychedelic. Polka Dot was the brand the reporter saw most often, and some of its bars appeared to be counterfeit.4

Some keep the stock hidden: one East Village store raided in 2022 sold from a back room, and a task force found apparent psilocybin products "hidden in a safe in the basement" of an Upper West Side smoke shop.5, 6 A June 2023 Council committee report put it plainly: "Reports indicate that psilocybin mushrooms and imitation cannabis products are also being sold in addition to unlicensed cannabis products as part of the proliferation of smoke shops across the city."6

Not every "mushroom" product there holds psilocybin. Some are sold as Amanita muscaria, which isn't on New York's controlled-substance schedules, and tests have found unlisted drugs in others (see below).1 Our page on whether Amanita muscaria is legal in New York covers those.

What happened to the shops that sold them?

These are the NYC shop and warehouse cases involving psilocybin we could document. We name businesses, not people.

NYC shop and warehouse cases involving psilocybin, 2022 to 2026
When and whereWhat happened
December 20, 2022
Come Back Daily, 516 E. 11th St., and City Clouds, 120 E. 7th St., East Village
After undercover buys, the NYPD and the Special Narcotics Prosecutor seized about 1,500 psilocybin pills, 59 bags of "Mushie" mushrooms, gummies and Polka-Dot bars. Four people were charged with criminal sale in the fifth degree.5
Reported January 2023
A smoke shop on the Upper West Side
A Sheriff, NYPD, Finance and cannabis-office task force found apparent psilocybin products in a basement safe.6
July 16 to 17, 2024
3770 and 4011 E. Tremont Ave., Throggs Neck, the Bronx: an unlicensed shop and a deli used as a front
The Sheriff and NYPD, under Operation Padlock to Protect, found psilocybin edibles at both addresses and psilocybin concentrate at 4011.7
July 21, 2024
516 Timpson Place, Mott Haven, the Bronx
The Sheriff and NYPD seized about 200 pounds of "psychedelic mushrooms, mushroom edibles and concentrate" with cannabis and guns. Four people were arrested.8
August 8, 2024
A warehouse at 26-32 Second St., Astoria, Queens
A search that began with a burglary call turned up cannabis products and "mushroom (psilocybin) chocolate bars," the Sheriff's Office said, in boxes with a name like One Up's. Two burglary suspects were arrested; the Sheriff's Office padlocked the warehouse.9

The 2024 cases came from the Sheriff's office, the two Bronx ones under Operation Padlock to Protect, the city's crackdown on unlicensed cannabis shops, which had shut down "nearly 1,400" shops by May 14, 2025.7, 8, 10 It targets cannabis; psilocybin turned up along the way. We found no NYC storefront case from 2025, and no NYC business in the news that openly called itself a mushroom dispensary. Upstate, the Office of Cannabis Management padlocked a Rome, NY shop in April 2026 after police recovered psilocybin mushrooms there.11

What's actually in shop products?

We found no published lab tests of products known to come from NYC shops. For its NYC report, DoubleBlind had ten products tested; the lab found 4-AcO-DMT, a synthetic psychedelic, unlisted in "Magic Kingdom" mints and gummies and in "Road Trip" gummies, and the article doesn't say where they were bought.4 Tests elsewhere point the same way:

  • FDA, 2024. In Diamond Shruumz bars, cones and gummies, FDA found muscimol in 9 of 22 chocolate bars tested, plus 4-AcO-DMT, psilocin and pregabalin. The outbreak count, which also took in other brands of mushroom chocolate, was 180 illnesses in 34 states, 2 of them in New York.12
  • CDC, Virginia, 2024. Of 6 packages of "mushroom" gummies bought at gas stations and smoke shops, 4 contained psilocybin or psilocin that wasn't on the label, and the tests also found unlisted ephedrine, kratom's mitragynine and DMT.13
  • Portland, Oregon, 2025. Of 8 gummy products from smoke and vape shops, 7 contained psilocin and 6 contained 4-AcO-DMT. One labeled psilocybin-free contained psilocybin, and two sold as Amanita had no muscimol or ibotenic acid.14

NYC's drug-checking sites test powders and pills, and "plant matter and most liquids cannot be tested."15 More in our guide to smoke-shop mushroom gummies and on the safety and help page.

Why does "licensed" mean nothing on a mushroom shop?

Because no one in New York can license it. The Cannabis Control Board's duties in Cannabis Law § 10 cover "medical cannabis, adult-use cannabis and cannabis product, and cannabinoid hemp and hemp extract," and psilocybin isn't among them; the office's padlock power in § 16-a also reaches only cannabis and hemp products.3 Psilocybin stays on Schedule I.1

Licensed cannabis dispensaries post a state verification sign with a QR code in the front window, a system introduced in December 2022.16 It tells you a store may sell cannabis, not mushrooms; a licensed store that sold psilocybin would be making the same criminal sale as an unlicensed one.2

Other words on a sign or package don't change that:

  • "Legal" or "licensed": no New York license covers psilocybin.
  • "Lab-tested": a lab report describes what was in a sample, not whether selling it is legal.
  • "Amanita": the tests above found psilocybin or psilocin, and in Portland other tryptamines, in products sold that way.

Is there a mushroom dispensary in Manhattan, Brooklyn, the Bronx, Queens or Staten Island?

Not a legal one. The same state law applies in every borough. Here's what we found:

Shop and warehouse cases by borough, December 2022 to November 2026
BoroughWhat we found
ManhattanTwo East Village storefronts raided in December 2022; an Upper West Side smoke shop with apparent psilocybin in a basement safe, reported in January 2023.5, 6
BrooklynNo storefront case found.
The BronxAn unlicensed shop and a deli front in Throggs Neck and a site in Mott Haven, all in July 2024.7, 8
QueensThe Astoria warehouse raid, August 2024.9
Staten IslandNo storefront case found.

"No case found" means none in police, prosecutor and news reports, not that no shop there sells mushrooms. Our NYC overview has the full enforcement timeline, including Washington Square Park.

Why do searches for a mushroom dispensary in NYC show shops in other cities?

When we searched "mushroom dispensary nyc" on November 2, 2026, the top results included directory listings for stores that aren't in New York: one titled "New Yorkers 1st Choice" with a street address in Tampa, Florida, and another in Colorado Springs. Others were spam planted on hacked or abused university and public-library web folders, with titles like "Your Local Mushroom Dispensary: Is It Closer Than You Think?", plus Canadian dispensary news and culinary mushroom farms.

We aren't linking them. A listing that ranks for "NYC" isn't evidence of a store in NYC, and no store in New York can sell psilocybin legally anyway.

Questions people ask

Why do some smoke shops sell mushrooms openly if it's illegal?

Being on a shelf doesn't make it legal. The city's storefront crackdown, Operation Padlock to Protect, was built for unlicensed cannabis, and psilocybin turned up during some of its raids.10 Selling psilocybin is still a felony, and shops in the East Village and the Bronx have been raided for it.2, 5, 7

Can a licensed cannabis dispensary sell magic mushrooms?

No. Its license comes from the Office of Cannabis Management and covers cannabis and hemp. Psilocybin is a Schedule I drug that no New York license covers.3, 1

Can I get in trouble for buying from a shroom shop?

Yes. Possessing any amount is criminal possession in the seventh degree, a class A misdemeanor, and it becomes a class C felony at 25 milligrams of psilocybin.2 Our penalties guide has the full table.
